On Friday, a U.S. appeals court upheld the decision to put a hold on the federal order by President Biden for companies with 100 workers or more to require COVID-19 vaccines. The Court rejected a challenge by President Biden’s administration. This comes after many states have begun passing anti-vaccine discrimination laws.
The order does not specify whether its stay extends beyond the Fifth Circuit, but it enjoins the federal government from taking any action to enforce the ETS while it is in effect. As such, the stay’s practical effect is a nationwide pause.
